Terms of Service

These Terms of Service ("Terms") govern your access to and use of AEassistant, the website at aeassistant.com, and related services (collectively, the "Service"), operated by Calibrated Valuation LLC ("Company," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

AEassistant is a subscription tool for mortgage and lending professionals. It uses artificial intelligence to answer questions about mortgage program guidelines and to perform income calculations based on information you provide.

2. Informational tool — not professional advice

AEassistant is an informational and productivity tool only. Its outputs are generated by artificial intelligence and are provided for general reference and convenience. They may be incomplete, outdated, or incorrect, and they do NOT constitute legal, financial, tax, underwriting, compliance, or other professional advice. You are solely responsible for independently verifying all information against the official, current guidelines published by the relevant agency, investor, or authority — including FHA/HUD, the VA, Fannie Mae, and Freddie Mac — and for exercising your own professional judgment before relying on any output for a loan decision or any other purpose. Calibrated Valuation LLC is not responsible for any decision made or action taken in reliance on the Service's outputs.

3. No affiliation

Calibrated Valuation LLC and AEassistant are independent and are not affiliated with, endorsed by, or sponsored by the U.S. Department of Housing and Urban Development (HUD), the Federal Housing Administration (FHA), the U.S. Department of Veterans Affairs (VA), Fannie Mae, Freddie Mac, or any government agency or government-sponsored enterprise. All program names and trademarks are the property of their respective owners and are used for identification and descriptive purposes only.

4. Eligibility and accounts

You must be at least 18 years old and using the Service for business or professional purposes. You are responsible for the accuracy of your registration information and for keeping your login credentials confidential. You are responsible for all activity that occurs under your account. Notify us promptly of any unauthorized use.

5. Free trial, subscriptions, and billing

The Service is offered on a subscription basis at $19.95 per month, following a 30-day free trial. No payment information is required to begin the free trial. If you subscribe, payments are processed by our payment processor (Stripe); we do not store your full card details. Subscriptions renew automatically each month until canceled. You may cancel at any time; your access continues through the end of the period you have already paid for, and fees already paid are non-refundable except where required by law. We may change pricing on a going-forward basis with reasonable notice.

6. Acceptable use

You agree not to: misuse the Service or interfere with its operation; attempt to gain unauthorized access to it; reverse engineer, scrape, or copy it except as permitted by law; resell or provide access to others outside your account; or use the Service for any unlawful purpose. We may suspend or terminate accounts that violate these Terms.

7. Your content

You retain ownership of the information you input into the Service ("Your Content"). You grant us a limited license to process Your Content solely to operate and provide the Service to you. You are responsible for ensuring you have the right to submit any information you input, including information about third parties such as loan applicants, and for complying with all applicable laws and professional obligations regarding that information.

8. Intellectual property

The Service, including its software, design, and content (excluding Your Content), is owned by Calibrated Valuation LLC and protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription.

9. Disclaimer of warranties

The Service is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that its outputs will be accurate or reliable.

10. Limitation of liability

To the maximum extent permitted by law, Calibrated Valuation LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or business, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless Calibrated Valuation LLC from any claims, losses, or expenses arising out of your use of the Service, Your Content, or your violation of these Terms or applicable law.

12. Termination

You may stop using the Service and cancel at any time. We may suspend or terminate your access if you violate these Terms or for any lawful reason. Upon termination, your right to use the Service ends.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by email or through the Service). Your continued use after the changes take effect constitutes acceptance.

14. Governing law

These Terms are governed by the laws of the State of Oregon, without regard to its conflict-of-laws rules. Any dispute will be subject to the exclusive jurisdiction of the state and federal courts located in Oregon.
